"PUT THAT LIGHT OUT ! ! !"

I purchased a WORKZONE 150w Halogen Floodlight from an ALDI store on the 19th March 2007 and attempted to install it last week. After wiring it up and attempting to set it the light refused to go out and therefore I considered it to be faulty.

When I attempted to return it to the store today ( Saturday 28th April 2007 ) I was refused a replacement ( as the floodlight was one of ALDI's 'weekly specials' they were all sold ) or refund and was told " as it was over 30 days from the date of purchase " to contact the manufacturer.

After consulting my Trading Standards Service they advise the following :-

" I have just purchased a product that is faulty. Is it the manufacturer's responsibility to rectify any faults ? "

Answer

The manufacturer will only have liability if the goods are covered by a guarantee, and then only if the guarantee covers the fault in question.

The law considers that the seller of the goods is always liable for breaches of contract, such as goods being faulty, so, even if there is a guarantee, the seller must rectify the faults if you ask him / her to.

Regarding your ' over 30 days rule ' :-

" I took some faulty goods back to the shop, but the trader pointed to a notice which stated "No Refunds". Is this correct ? "

Answer

No ! Traders cannot restrict their liability for faulty goods. In fact, these notices are illegal and the trader could be prosecuted by Trading Standards.

Therefore in accordance with Sale of Goods Act 1979 I wrote to the store manager and advised them I wish to reject the goods and claim a refund. and asked for a responce to my complaint within the next seven days..
